Privacy Policy

1. Introduction

This Privacy Policy explains how [Opener Pty Ltd / ABN to be inserted] ("Opener", "we", "us", or "our") collects, uses, stores, discloses, and otherwise handles your personal information when you use the Opener mobile application ("App") and any related website or services (together, the "Service").

We are committed to protecting your privacy and handling your personal information in accordance with the Australian Privacy Principles ("APPs") set out in the Privacy Act 1988 (Cth) ("Privacy Act") and any other applicable privacy legislation.

By using the Service, you acknowledge that you have read and understood this Privacy Policy. If you do not agree with our practices, please do not use the Service.

2. What Personal Information We Collect

We collect and handle the following types of personal information:

2.1 Information you provide directly

  • Account information: Name, email address, and password when you create an account.
  • Taste preferences: Genre selections, vibe selections, and event reactions you provide during the Soundcheck onboarding flow or through ongoing use of the App.
  • Location data: Your city or geographic location, either entered manually or provided via device location services, to show you relevant local events.
  • Feedback and communications: Any messages, feedback, or support requests you send to us.

2.2 Information collected automatically

  • Device information: Device type, operating system, unique device identifiers, and app version.
  • Usage data: How you interact with the App, including screens viewed, events browsed, swipe actions (save, skip, view details), search queries, and filter selections.
  • Log data: IP address, access times, and referring URLs.
  • Analytics data: Aggregated and anonymised usage patterns to help us improve the Service.

2.3 Information from third-party services

  • Spotify or music service data: If you choose to connect your Spotify account (or another supported music service), we access your listening history, top artists, and top genres to improve your event recommendations. We do not access your Spotify login credentials, payment information, or any data beyond what is necessary for taste matching. You can disconnect your music service at any time.
  • Third-party authentication: If you sign up or log in using a third-party service (such as Apple Sign In or Google Sign In), we receive basic profile information as authorised by you during the sign-in process.

2.4 Information we do not collect

  • We do not collect sensitive information as defined under the Privacy Act (such as health information, racial or ethnic origin, political opinions, religious beliefs, sexual orientation, or criminal records).
  • We do not collect payment or financial information. All ticket purchases occur through third-party ticketing providers, and we have no access to your payment details.

3. How We Use Your Personal Information

We collect and use your personal information only for purposes that are reasonably necessary for, or directly related to, providing and improving the Service. These purposes include:

  • Providing the Service: Displaying relevant event listings based on your location, building and refining your taste profile to power recommendations (Your Night, Worth a Look, Wild Card tiers), enabling you to save events to My Gigs, and sending you event reminders you have opted into.
  • Improving the Service: Analysing usage patterns (in aggregate) to improve the App's features, recommendation accuracy, and overall user experience.
  • Communications: Responding to your enquiries and support requests, and sending service-related notices (such as security alerts or changes to our Terms or this Policy).
  • Safety and security: Detecting and preventing fraud, abuse, or other harmful activity, and ensuring the security of the Service.
  • Legal compliance: Complying with applicable laws, regulations, and legal processes.

We will not use your personal information for purposes materially different from those described in this Policy without first notifying you and, where required by law, obtaining your consent.

4. Recommendations and Automated Decision-Making

Opener uses automated processes to generate event recommendations for you. Your taste profile — built from your Soundcheck selections, genre and vibe preferences, connected music service data (if provided), and your swipe and browsing behaviour — is used by our recommendation system to categorise events into three tiers:

  • Your Night — events that closely match your taste profile.
  • Worth a Look — events adjacent to your taste that we think are worth exploring.
  • Wild Card — events outside your usual preferences that could surprise you.

These recommendations are designed to help you discover live music, not to make decisions that significantly affect your legal rights or interests. The recommendation system does not determine pricing, access to events, or any other outcome with material consequences for you.

You can reset or modify your taste profile at any time through the App settings, including by re-doing the Soundcheck, disconnecting a linked music service, or adjusting your genre and vibe selections.

5. How We Share Your Personal Information

We do not sell your personal information. We do not share your personal information with third parties for their own marketing purposes.

We may disclose your personal information in the following limited circumstances:

5.1 Service providers

We engage trusted third-party service providers to help operate and improve the Service (for example, hosting, analytics, and error monitoring). These providers only access your personal information to the extent necessary to perform their services for us and are contractually required to handle it in accordance with applicable privacy laws.

5.2 Analytics

We use analytics services (such as Amplitude, Mixpanel, or similar tools) to understand how the App is used in aggregate. Where possible, analytics data is anonymised or pseudonymised before processing.

5.3 Legal requirements

We may disclose your personal information if required to do so by law, regulation, legal process, or enforceable government request, or to protect the rights, property, or safety of Opener, our users, or the public.

5.4 Business transfers

If Opener is involved in a merger, acquisition, or sale of assets, your personal information may be transferred as part of that transaction. We will notify you of any such change and any choices you may have regarding your information.

5.5 With your consent

We may share your personal information with third parties where you have given us your explicit consent to do so.

6. Overseas Disclosure

Some of our service providers may be located outside Australia (for example, cloud hosting, analytics, or error monitoring services). Before disclosing personal information to an overseas recipient, we take reasonable steps to ensure that the recipient handles your information in a manner consistent with the APPs, as required by APP 8.

Where we use overseas service providers, we will take reasonable steps to ensure your information is protected through contractual arrangements or other appropriate measures. 7. Cookies and Tracking Technologies

The App and any associated website may use cookies, local storage, and similar technologies to improve your experience, remember your preferences, and collect usage data.

You can manage your cookie preferences through your browser or device settings. Disabling certain cookies may affect the functionality of the Service.

We do not use tracking technologies to serve you targeted advertising from third parties within the App.

8. Data Security

We take reasonable steps to protect your personal information from misuse, interference, loss, and from unauthorised access, modification, or disclosure. Our security measures include:

  • encryption of data in transit (TLS/SSL);
  • secure storage of data at rest;
  • access controls limiting who can access personal information within our team;
  • regular review of our data handling practices; and
  • incident response procedures for potential data breaches.

No method of electronic storage or transmission is completely secure. While we strive to protect your information, we cannot guarantee absolute security.

9. Data Retention

We retain your personal information only for as long as reasonably necessary to fulfil the purposes described in this Policy, or as required by law. Specifically:

  • Account data: Retained while your account is active and for a reasonable period after deletion to allow for account recovery and comply with legal obligations.
  • Taste profile data: Retained while your account is active. Deleted or anonymised when your account is deleted.
  • Usage and analytics data: Anonymised or aggregated where possible. Raw usage data is retained for no longer than [24 months — to be confirmed] before being anonymised or deleted.
  • Communications: Support correspondence is retained for [12 months — to be confirmed] after resolution.

When your personal information is no longer needed, we will take reasonable steps to destroy or de-identify it.

10. Notifiable Data Breaches

In accordance with Part IIIC of the Privacy Act, if we become aware of an eligible data breach that is likely to result in serious harm to you, we will notify you and the Office of the Australian Information Commissioner ("OAIC") as soon as practicable.

11. Your Rights

Under the Privacy Act and the APPs, you have the following rights in relation to your personal information:

11.1 Access

You may request access to the personal information we hold about you. We will respond to your request within a reasonable period (generally within 30 days). In most cases, there is no charge for accessing your personal information, though we may charge a reasonable fee for retrieving information that requires significant effort.

11.2 Correction

If you believe that any personal information we hold about you is inaccurate, incomplete, out of date, or misleading, you may request that we correct it. You can update most of your information directly through the App settings.

11.3 Deletion

You may request that we delete your personal information by deleting your account through the App or by contacting us. We will comply with your request unless we are required by law to retain the information. Upon deletion, we will take reasonable steps to destroy or de-identify your personal information.

11.4 Anonymity and pseudonymity

In accordance with APP 2, you have the option of not identifying yourself, or using a pseudonym, when dealing with us — unless it is impracticable for us to deal with you without identification (for example, to provide account-based features).

You can browse event listings without creating an account or identifying yourself.

11.5 Withdraw consent

Where we rely on your consent to collect or use personal information (such as connecting a Spotify account), you may withdraw that consent at any time through the App settings. Withdrawal of consent does not affect the lawfulness of processing carried out before the withdrawal.

11.6 Opt out of marketing

You may opt out of receiving promotional communications from us at any time by using the unsubscribe link in any marketing email, adjusting your notification settings in the App, or contacting us directly.

12. Children's Privacy

Opener is not directed at children under 16. We do not knowingly collect personal information from children under 16. If we become aware that we have collected personal information from a child under 16 without appropriate parental consent, we will take steps to delete that information as soon as practicable.

We are aware of the Australian Government's development of a Children's Online Privacy Code under the Privacy Act, and we will comply with any applicable requirements as they come into effect.

13. Third-Party Services

The App may contain links to or integrations with third-party services, including ticketing providers (such as Ticketmaster, Eventbrite, Oztix, Moshtix, and others), music streaming services (such as Spotify or Deezer), and authentication providers. These third parties have their own privacy policies, and we encourage you to review them.

When you leave the App to complete a ticket purchase or interact with a third-party service, your personal information is handled by that third party in accordance with their own privacy practices. Opener is not responsible for the privacy practices of third-party services.

14. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, the Service, or applicable law. If we make material changes, we will notify you through the App or by other reasonable means before the changes take effect.

The "Last updated" date at the top of this Policy indicates when it was most recently revised. We encourage you to review this Policy periodically.
